    CEHAT press release sets facts straight on 2-finger test:
    Statement on National Guidelines for Responding to Sexual Assault Cases
    On the 4th and 5th of March 2013, several reputed news papers including the Hindu, Times of India and Daily Bhaskar reported that the Union Health Ministry of the Government of India has issued new national guidelines for dealing with sexual assault cases. According to the news reports, the Department of Health Research (DHR), ICMR, with the help of experts, formulated this set of guidelines. The papers have reported that the new guidelines have done away with the “maligned two-finger test that was used by doctors to opine whether the girl is habituated to sexual intercourse or not”. A look at the icmr website (icmr.nic.in), however, reveals otherwise.
    The guidelines, which had been prepared in the year 2012 and later re-released by the DHR in December 2013, have been withdrawn by them. In fact, the website clearly says that: “Further consultation on the matter is being undertaken in the Ministry of Health and Family Welfare”. (http://icmr.nic.in/dhr/explanatory%20note.pdf) There is no new indication on the website that the DHR has released new guidelines in March 2014. In March 2013 the MoHFW appointed a National Committee for formulating protocols and guidelines for responding to sexual violence. The committee was asked to go into all aspects related to the Ministry of Health and Family Welfare, in connection with the victims of sexual violence and sexual assault. The mandate of the committee was to look at the protocols created by the DHR and others, and finalize a proforma and manual for medical examination in cases of sexual assault, in accordance with recommendations of the Justice Verma Committee Report as well as International Standards. This proforma and manual would be implemented at the national level so that there is uniformity in protocols across the country. The committee has finalized the protocols and guidelines in its meeting held on 20 Dec 2013. We demand that the Ministry release these at the earliest and stop this confusion.
    Moreover, the guidelines which had been released in December 2013 by DHR ( ICMR) and are now being reported by the press as gender sensitive, were not in consonance with International Standards, and had therefore been revoked by the Health Department. The problems were as follows:
    The manual asks the doctor to record ‘elasticity of the vagina or anus’. This essentially means conducting the degrading two finger test, as that is the only way to determine elasticity!
    The manual and protocol ask the doctor to record age and position of tears, even as they mention that old tears are relevant. Recording of old tears is essentially an indication of past sexual history and is thus irrelevant to a case of sexual assault. Further, inferences drawn from whether the tears are symmetrical or asymmetrical, regarding whether the intercourse was consensual or not, are unscientific and subjective.
    Critical information which has bearing on the examination findings and collection and interpretation of forensic evidence is absent from the proforma. This includes non-penetrative forms of assaults (forced kissing, fondling, forced masturbation of the survivor or survivor was made to perform masturbation of the perpetrator), use of lubricants, threats, whether the condom used was torn or un-torn, time lapsed between the assault and examination.
    Non-integration of therapeutic and forensic roles: The neglect of the doctor’s therapeutic role at the cost of his forensic role is evident in the fact that the guidelines separated out treatment as a component of care completely. The aspect of psychosocial support to be given to the survivor was not addressed in the guidelines at all, even though provision of basic psychological first aid is the responsibility of the health care provider even in low resource settings.
    No recognition of special survivor groups: As per the reformed law, not just women and girls but also boys, transgender and intersex people may be subjected to sexual assault. The document does not attempt to educate health professionals about the specific vulnerabilities of different survivors, which may enable them to provide sensitive care. The description of genitalia in the form doesn’t include sex organs of inter sex persons.
    Now, there is once again talk of introducing these guidelines. Given the current lacunae, the guidelines are not likely to take care of the existing malaise in the health system vis-à-vis its response to sexual assault. In fact, they will continue to perpetuate the problems if they are implemented. We demand that newspapers issue an apology for reporting news that is, in fact, false.

  • ধুর, গাড়ির মাথায় ছাদ থাকেনা। হয়েছে কি, মাথার উপর দিয়ে একটা ফ্রি-ওয়ে গেছে। লোকজন ভোরভোর গিয়ে তার নিচে গাড়ি পার্ক করে দেয়। তারপর মনে হয় হেঁটে বাড়ি ফিরে আবার হেঁটে আপিস যায়।

    আমি যথেষ্ট ভোরে যাই এখন, কিন্তু ওইসব জায়গা পাইনা। একটা সামান্য পার্কিং স্পেসের জন্য আর কত কিছু করব?
